Terms & Conditions
These Terms & Conditions govern your use of the Komorebi platform and any purchases you make through it. Komorebi is operated by Vizora Interactive (“we”, “us”, “our”). For general information about Vizora Interactive and its broader services, visit vizora-interactive.com.
Please read these terms before making a purchase. By placing an order you agree to them.
1. Scope
These Terms apply to all orders placed on Komorebi, including physical merchandise, digital products (e.g. digital art, voice packs, music, virtual assets), and subscriptions. If you are purchasing as a consumer (outside your trade or profession), additional statutory consumer protections apply.
2. Applicable Rules and Hierarchy
These Terms form the core agreement for Komorebi purchases. Additional rules are incorporated by reference: Withdrawal Policy, Komorebi Seller terms (for sellers), and any product-specific conditions shown at checkout. Order of precedence: individual written agreement → product-specific conditions → these Terms.
3. Language
These Terms are provided in English. EU consumers who do not sufficiently understand English may contact us at legal@vizora-interactive.com before placing an order. Any ambiguity will be interpreted in accordance with applicable consumer protection laws.
4. Eligibility
Komorebi is generally intended for users 16 years of age or older. Minors aged 16–17 may make purchases subject to applicable parental consent requirements under applicable law.
5. User Accounts
Some features require a Komorebi account. You are responsible for maintaining the confidentiality of your credentials, all activity under your account, and notifying us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
6. Prohibited Conduct
When using Komorebi, you must not: violate applicable laws; infringe intellectual property rights; submit fraudulent orders or withdrawal declarations; attempt to gain unauthorised access to our systems; use the platform for commercial resale without written permission; or engage in conduct that harms other users or the platform.
7. Fan Content and Intellectual Property
Product designs sold via Komorebi that are based on Vizora or creator IPs are subject to the Content Usage Guidelines. Non-commercial fan use is generally permitted. Using Komorebi product designs or assets in AI training datasets or model inputs without written consent is not permitted. Artist-created designs remain the intellectual property of the respective artists; Komorebi holds a limited licence to sell and fulfil those products.
8. Intellectual Property (Komorebi platform)
Komorebi platform content, branding, and design assets are owned by Vizora Interactive or licensed to us. They may not be reproduced, redistributed, or used commercially without prior written permission.
9. Games and Game Servers
This section does not apply to Komorebi. For Vizora Interactive game purchases and server access, see vizora-interactive.com/terms.
10. Physical and Digital Products
10.1 Physical products
Physical products are produced and shipped via our fulfilment and production partners. Most products are print-on-demand and produced only after your order is placed. Estimated production and delivery times are shown at checkout. We ship worldwide subject to our restricted country list. Customised or made-to-order items cannot be returned unless defective — see the Withdrawal Policy.
10.2 Digital products
Digital products (e.g. digital art, wallpapers, voice packs, music downloads, virtual assets) are delivered electronically. Delivery typically begins immediately after purchase confirmation. Where legally required, we will ask for your explicit consent and acknowledgement that your right of withdrawal expires once delivery begins.
10.3 Early access and pre-orders
Some products may be offered as pre-orders. “Release” means first availability unless explicitly stated otherwise. We allow voluntary cancellation of pre-orders up to 14 days before release, in addition to statutory consumer rights.
11. Physical Goods and Digital Products (Komorebi)
See Section 10 above. For warranty rights and return conditions, see our Withdrawal Policy.
12. Orders and Contract Formation
Placing an order constitutes a binding offer to purchase. A contract is formed when we confirm your order by email. We reserve the right to decline orders where a product is out of stock, where a pricing error has occurred, or where we suspect fraud.
13. Subscriptions (Rebi)
Komorebi offers the Rebi subscription. Subscriptions renew automatically and can be cancelled at any time via your account settings, effective at the end of the current billing period. An online cancellation function is available in accordance with § 312k BGB, clearly labelled and accessible without login. After cancellation, subscription benefits remain available until the end of the current billing period.
14. Creator Support
Artist-created designs on Komorebi generate royalties for the respective creators. Voluntary support through tipping or similar mechanisms is governed by the rules of the respective platform. This does not constitute a purchase contract with Vizora Interactive unless explicitly stated.
15. Talent and Partner Programs
Komorebi Sellers operate under a separate Seller Agreement (B2B). Consumer-facing terms on this page do not apply to the Seller relationship. For seller enquiries: Sellers@komorebi.gg
16. Prices, Payments, and Email Communications
All prices include applicable VAT where required. We accept: credit/debit cards, Apple Pay, Google Pay, PayPal, Klarna, ClearPay, iDEAL, Wero, Bancontact, EPS, giropay, Multibanco, Przelewy24 (P24), Alipay, WeChat Pay, Amazon Pay, and offline payment at events. Buy now, pay later options are subject to the payment provider’s own eligibility criteria and credit assessment (subject to CCD II from 20 November 2026). We may send promotional emails — all are opt-in only and you can unsubscribe at any time.
17. Enforcement
17.1 Enforcement approach
We aim for fair, proportionate enforcement considering severity, intent, and prior behaviour.
17.2 Typical steps
Warnings, order cancellations, account suspensions, or permanent bans depending on severity.
17.3 Escalation
Repeated or serious violations (including fraudulent withdrawal declarations) may result in civil recovery action or referral to relevant authorities.
17.4 Immediate action
We may act immediately to prevent ongoing harm, protect users, or comply with legal obligations.
18. Liability
We are liable without limitation for intent and gross negligence, injury to life, body, or health, and liability that cannot be limited by law. For minor negligence, liability is limited to foreseeable, typical damages arising from breach of essential contractual obligations. We are not responsible for third-party platform conduct or service disruptions unless required by law.
19. B2B Services
Komorebi Seller relationships are governed by the Seller Agreement, not these Terms. For other B2B engagements with Vizora Interactive, see vizora-interactive.com/terms.
20. Withdrawal Rights
As a consumer, you generally have a 14-day right of withdrawal for distance purchases, subject to legal exceptions. Full details, exceptions, and the online withdrawal function are in our Withdrawal Policy. You can exercise your right of withdrawal online via the “Withdrawal” button in the Komorebi footer, available at komorebi.gg/revoke. From 27 September 2026, a harmonised EU statutory warranty notice will appear on all product pages.
21. Governing Law and Jurisdiction
These Terms are governed by German law, excluding the CISG. For consumers, this does not remove mandatory protections of the country of residence. We are not willing or obliged to participate in dispute resolution before a consumer arbitration board.
EU Online Dispute Resolution: ec.europa.eu/consumers/odr
22. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain unaffected.
23. Changes
We may update these Terms to reflect changes in our services or legal requirements. Material changes will be communicated in advance via this website or email where possible. The effective date is shown at the top of this page.
