Whether you’re reporting an infringement or handling a claim, we try our best to ensure a fair and efficient process for all parties involved. We take copyright infringement seriously and work diligently to maintain a respectful and compliant environment for creators and users alike.

Reporting Infringements

Reporting copyright infringements is essential to uphold the integrity of our platforms and respect the rights of any involved party. If you suspect that your copyrighted work has been used or distributed on Vizora Interactive Platforms without proper authorization, you can submit a report through using our Contact Section, which includes E-Mail, Letter, or Discord.

  • Reporting: Submit reports through our designated channels. All reports are being handled by Vizora Interactive Employee’s and Volunteers within 48 Hours.
  • Investigation: To ensure a thorough investigation, we would have to ask you to prepare the following Documents upon request:
    • Copyright registration document: We would like to make sure you are the rightful owner of the Copyright or Trademark, and will ask you for the Copyright registration document upon the start of the conversation. This document will only be accepted via E-Mail, or Letter.
    • Copyright Transfer documents: If the Copyright has been transferred, please provide related documents additionally to the Copyright registration.
Handling Infringement Claims

If you believe that your copyrighted work has been infringed upon on our platforms, we take such claims seriously and have the following procedures in place to address them promptly:

  • Reporting Process: To report an infringement, you can submit a formal complaint through our designated channels. We require specific information to process these claims effectively, including details about the allegedly infringing material and proof of your ownership of rights (e.g. Copyright registration document).
  • Review and Assessment: Once we receive your request, our team will review the provided information and assesses its validity. This may involve examining the allegedly infringing material and comparing it with the original work in question.
  • Communication: We maintain open communication throughout the process, and ensuring you are informed and up to date on the status of the claim and any actions taken. Transparency is a very important value to Vizora Interactive.
  • Resolution: Depending on the outcome of our assessment, we take appropriate action to address the infringement. This may include removing the infringing material from our platforms, disabling access to it, or working with the parties involved to reach a resolution.

Intellectual Property Management

We respect the legal frameworks of others, and hope they will handle our IPs the same way as we handle theirs. Our IP management practices aim to ensure fairness, transparency, and compliance with applicable laws and regulations. We provide guidelines for the fair use of our materials, outline procedures for obtaining permission, and establish rules for attributing intellectual property rights correctly.

 

Fair Use Policies

TL;DR: Our fair use policies allow for the creation of derivative works for non-commercial, & limited commercial community use, provided they are original, respectful, and compliant with laws and regulations. Please learn more about specifics in the Derivative Work Category.

  • Commercial Use: Derivative Works created under our fair use policies are intended for non-commercial, or limited commercial use only. Projects aimed only at generating revenue must obtain explicit permissions from us.
  • Community Projects: We value Community Projects and would love to see our Community sharing their passion with others, but to keep it fair and square, we ask to check the Derivative Work Category before creating a Community Project.
  • Originality and Creativity: We encourage creators to add original and creative elements to derivative works. Simply reusing or replicating existing content without adding substantial creative input may not align with our fair use policies.
  • Respectful Representation: Derivative works should be respectful towards our Talents, Content, and Community. Content that is offensive, inappropriate, or derogatory will not be tolerated (Criticism is fine, but do not confuse it with hate).
  • No False Representation: Avoid marking derivative works as official content, endorsed, or produced by Vizora Interactive, or related Brands, Staff & Talents.
  • Compliance with Laws: Creators are expected to comply with all applicable laws, regulations, and platform policies when creating derivative works. This includes respecting the copyright of potential third-parties.
Permission Requests

If you’re considering using Vizora Interactive’s intellectual property (IP) in a way that isn’t covered by our standard policies or guidelines, such as Commercial Use for a Product, you may need to request permission. Here’s what you need to know:

  • Request Process: Permission requests should be submitted in writing to ips@vizora-interactive.com. Please provide detailed information about your proposed use of our IP, including how, when and where it will be used, and any other relevant details.
  • Consideration: We review each request carefully to consider factors such as the nature of the proposed use, potential impact on our brands, community, and alignment with our values and policies.
  • Response Time: Each request is being worked on separately, but we try to respond in a timely manner. It might take up to a week until for a response.
  • Conditions: If your request is approved, there might be conditions or limitations imposed on the use of our IP. These could include restrictions on commercial use, attribution requirements, or other terms deemed necessary.
  • Appeals: If your request is denied or if you have concerns about the decision, please submit a request by our channels of communication provided on the contact page. We ask you to provide any additional information or context that you believe may support your case.

Intellectual Property Usage

As much as we love to see our IPs becoming more popular and entering new domains, we would like to ensure that our IPs are being used fairly and without malicious intentions.

  • Scope of Use: Generally, creators are permitted to use Vizora Interactive’s logos, trademarks, and talent likenesses within the scope of our policies. This includes incorporating them into derivative works, fan content, and other creative projects inspired by our IP, however we advise having a look into our Fair Use Policies and Derivative Work Category to avoid conflicts.
  • Commercial Use: While non-commercial use of our IP is generally permitted, commercial use, such as selling merchandise featuring our logos or talent likenesses, requires explicit permission from Vizora Interactive.
    Creators should contact us to obtain the necessary permissions.
Intellectual Property Rights (IPRs) of Artists, Partners & Shareholders

We highly value the Intellectual Property rights of our Artists, Partners, and Shareholders. These rights play a crucial role in fostering creativity, innovation, and collaboration within our Company, and Community.

  • Ownership: Artists, Partners, and Shareholders retain ownership of their intellectual property. This includes but is not limited to the original artwork, music compositions, character designs, and any other creative works produced.
  • Licence Agreements: Vizora Interactive may enter licence agreements with Artists, Partners, and Shareholders to utilize their intellectual property for specific purposes. These agreements outline the terms of use, including any compensation arrangements and restrictions on usage, therefore we encourage asking before using materials you find on our Platforms!
  • Protection: We are committed to protecting the intellectual property rights of our Artists, Partners, and Shareholders. This includes taking necessary measures to prevent unauthorized use, reproduction, or distribution of their creative works that have been created for Vizora Interactive.
  • Respect and Recognition: We respect the creative contributions of our Artists, Partners, and Shareholders and strive to provide appropriate recognition for their work. This may include crediting them in promotional materials, acknowledging their contributions in public appearances, and showcasing their creations.
  • Enforcement: In cases of intellectual property infringement or misuse, we will take appropriate enforcement actions to safeguard the rights of our Artists, Partners, and Shareholders. This may involve issuing cease and desist notices, pursuing legal remedies, or taking other measures to address the infringement.

When you’re using Vizora Interactive’s intellectual property, proper attribution is essential to ensure transparency and respect for the original creators. By adhering to those requirements, you can set the first stone for a positive relationship and contribution to the promotion and recognition of our brands and talents.

  • Clear Attribution: It’s required to clearly display attribution to Vizora Interactive and any relevant talents involved. This includes providing credit for the original content and acknowledging the creators behind.
  • Consistent Branding: Ensure that any use of Vizora Interactive’s logos, trademarks, or other branding elements is consistent with our branding guidelines. This helps maintain brand integrity and prevents confusion.
  • Respectful Representation: Attribution should be done in a respectful and accurate manner, avoiding any misrepresentation or false claims regarding the origin of the content or its nature.
  • Visibility: Attribution should be easily visible-, and/or accessible to viewers or users. This could include placing attribution information in the video description, on the product packaging, or within the app interface.

Digital Rights Management

We have various Digital Right Management (DRM) measures in place to safeguard our intellectual property and ensure fair use by our community and partners. This section is specializing on the protection and management of our Digital Content.

Content Protection Measures

Artworks & 3D Models

Artworks and 3D models inspired by Vizora Interactive and our talented individuals contribute significantly to our community’s vibrant creativity.
While we celebrate this expression, it’s important to ensure that these creations align with our values and guidelines.

  • Originality and Creativity: We encourage artists to use their own unique style and creativity into their artworks and 3D Models. Simply replicating existing content without adding substantial creative input may not align with our vision.
  • Respectful Representation: Artworks and 3D models should always respect our talents, content, and community.
  • Monetization and Commercial Use: Creators are permitted to enable monetization on videos featuring their artworks and 3D models. Displaying these creations on platforms like Patreon is permitted as well, however explicit permission is required if creators intend to use these creations for commercial purposes, such as merchandising or direct sales to third-parties.
  • Attribution: Proper attribution is essential when sharing derivative works.
    We encourage Artists and Modellers to clearly credit the original source and indicate that the artwork or 3D model is a fan creation.
  • Compliance with Laws: Creators are expected to adhere to all applicable laws, regulations, and platform policies when producing derivative works. This includes respecting the intellectual property rights of third parties.
  • Artificial and NSFW Creations: We allow Artificial and NSFW creations as long it has been properly tagged and/or restricted to appropriate platforms. Creators who create NSFW content should also ensure that the content is clearly marked and only accessible to those who wish to access it.
Clips & Compilations

Clips, Compilations, or even Fan-Edits play a vital role in showcasing memorable moments and highlights from our talented individuals streams and content.
To ensure that these creations contribute positively to our community, we would like everyone to adhere to a few guidelines:

  • Content Selection: Creators are encouraged to curate clips, compilations, and fan-edits that highlight engaging and entertaining moments from our talents streams and content. These clips should provide context, and/or have a notice that leads to the Original Source, e.g. by linking the original stream or content.
  • Respectful Representation: Clips, compilations, and Fan-Edits should always respect the integrity and image of our talents, content, and community. Any content that is offensive, inappropriate, or derogatory will not be tolerated.
  • Monetization: Creators are permitted to monetize their Clips, Compilation, and Fan-Edits through various sources, which includes partner/creator programs on video-sharing platforms, the creator’s merchandising or sponsorships and partners that have been approved by Vizora Interactive.
  • Compliance with Laws: Creators are expected to comply with all applicable laws, regulations, and platform policies when creating and sharing Clips, Compilations, and Fan-Edits. This includes respecting the intellectual property rights of third parties and adhering to copyright laws
Fan Advertisements

Woah, what a creative way to show support and appreciation for our talents and content! However, to ensure that your advertisements are respectful, authentic, and compliant with legal and ethical standards, we would like you to respect:

  • Authenticity and Transparency: Fan Advertisements should clearly indicate that they are fan-operated and not officially endorsed or produced by Vizora Interactive, our associated brands, staff, or talents. Transparency is key to maintaining trust and integrity within our Company and Community.
  • Respectful Representation: Advertisements should uphold the positive image and reputation of our talents, content, and community. Content that is offensive, inappropriate, or derogatory will not be tolerated and might be followed with legal action. Constructive criticism is acceptable, but content that promotes hate speech, harassment, or discrimination is strictly prohibited.
  • No False Representation: Advertisements must not falsely represent themselves as official content or imply an endorsement by Vizora Interactive, our brands, staff, or talents. This includes avoiding the unauthorized use of logos, trademarks, or other intellectual property owned by Vizora Interactive or our associated entities.
  • Compliance with Laws: Creators are expected to comply with all applicable laws, regulations, and platform policies when creating and sharing fan advertisements. This includes respecting the intellectual property rights of third parties and obtaining any necessary permissions or licences for copyrighted material.
  • Content Guidelines: Fan advertisements should avoid content that contradicts public order and morality, exceeds socially acceptable standards, promotes specific ideologies or beliefs, or infringes upon the rights of third parties. Advertisements should contribute positively to the community.
Music

Creators within our Community often express their creativity through music, including creating rankings, original compositions, covers, and remixes of existing songs featuring our talents. While we encourage this form of expression, it’s important to adhere to certain guidelines to ensure a fair ecosystem.

  • Original Compositions: We welcome original music compositions inspired by our talents and content. Creators are encouraged to share their original works!
  • Cover Songs: Covering songs performed by our talents is permitted, provided proper credit is given to the original creators (The Talent, Writers and Composers!).
  • Remixes and Adaptations: Remixes and adaptations of existing songs are allowed, as long they add a unique flair to the remixes to ensure they stand out.
  • Musical Rankings: Creators are free to add Originals, and Covers to their own Musical Ranking lists and content as long the chosen snippet of the Song won’t exceed 45 seconds. The Snippet might include video, and/or audio.
  • Usage of Music: Creators are free to share their musical creations on various platforms such as YouTube, SoundCloud, and other streaming services. However, they must ensure they comply with all applicable copyright laws and regulations.
  • Attribution: Proper attribution is essential when using our music. Creators should clearly credit the original song title and the associated talent or project.
  • Respectful Representation: Creators should always respect the integrity and artistic vision of the original. Creators should avoid altering or distorting the original content in a manner that could be considered disrespectful or offensive.
  • Monetization: Creators may monetize their music on platforms that allow it, such as YouTube and Spotify. However, they must ensure they have the necessary rights and permissions to do so (Check the description of our Songs!).
Games

We know our community is passionate about games, and some might even want to create games inspired by our talents and content. Whether it’s fan-made games, mods, or other interactive experiences, we encourage creativity and provide assistance in the creation, however each project have to follow these guidelines:

  • Vizora Game Creator Support Program (VGCSP): For creators intersted in developing fan-made games under an official program, we offer the VGCSP. This program provides support and resources for developing, hosting and publishing games under the Vizora Interactive brand.
  • Fan-Made Games: Creators are welcome to develop fan-made games featuring our talents and content. These games can include a wide range of genres, from visual novels to platformers, as long we’re being notified at least 3 months prior to any publication (This means, before it’s shared anywhere in public).
  • Modifications: Modifying existing games such as “Minecraft” to include our characters, themes, or other elements is permitted, provided it’s done respectfully and within the terms of the original game’s licence.
  • Distribution Platforms: Fan-made games can be distributed on platforms like Steam, itch.io, and other digital shopfronts, as long they comply with platform guidelines and our own policies.
  • Monetization: Creators may monetize their fan-made games through various means, including selling the game itself, offering in-game purchases, or accepting donations. However, we request a cut of 10% – 30% of the final profits (excluding donations), depending on the level of support provided by us. This ensures we can monitor, and continue supporting those projects in our community.
  • Copyright Considerations: Creators should respect the intellectual property rights of third parties when developing fan-made games. This includes obtaining proper permissions for any third-party assets used in the game.
  • Community Engagement: We encourage creators to engage with the community during the development process, soliciting feedback, and sharing updates on their projects. This helps foster a sense of collaboration for the project.
